These Terms and Conditions ("Terms") govern your access to and use of the mobile application, website, and services (collectively, the “Services”) provided by Simply Communication LTD ("Simply", "we", "our", or "us"). By accessing or using our Services, creating an account, or purchasing a data plan, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our Services.

1. Definitions

  • User: Any individual or legal entity using the Services.
  • Account: The user profile created on the Simply platform.
  • eSIM: A digital SIM profile that allows mobile connectivity without a physical SIM card.
  • Plan: A mobile data package purchased via the Simply app or website.
  • Platform: The Simply app and website.
     

2. Eligibility

To use our Services, you must be:

  • At least 18 years old (or of legal age in your jurisdiction); and
  • Capable of entering into a binding contract under applicable law.

Legal entities may use the Services via an authorized representative.

 

3. Account Registration

You may create an Account using:

  • A valid email address, or
  • Third-party OAuth login (Google, Facebook, Apple)

You are responsible for safeguarding your login credentials and all activity under your Account.

4. Services

Simply provides digital eSIM plans for internet connectivity in supported countries. We do not offer voice or SMS services unless explicitly stated in a specific plan.

All eSIMs are delivered electronically via QR code or direct installation through the app. No physical SIM cards or postal delivery are involved.

We reserve the right to update, modify, or discontinue any aspect of the Services at any time.

 

5. Orders and Payments

All purchases must be made through the Simply platform using the available payment options. Payments are processed via Flitt, which may support Apple Pay or Google Pay, depending on your device and region.

Prices and currencies vary by location and may be subject to taxes.

You are responsible for ensuring compatibility of your device before purchasing an eSIM.

 

6. eSIM Activation and Delivery

After a successful purchase:

  • You will receive instructions via email or in-app message to install the eSIM.
  • Activation may occur through a QR code or automatic installation, depending on device support.

We are not liable if your device does not support eSIM or is not compatible with our system.

A device compatibility check is available in-app and on our website. Please verify before purchase.

 

7. Refund Policy

You may be eligible for a refund if:

  • The eSIM was not downloaded or installed, and
  • You submit a refund request within 7 days of purchase.
     

Refunds will not be issued if:

  • The eSIM was activated, partially used, or misconfigured due to user error
  • Your device is not eSIM-compatible, and this was not verified before purchase
  • The plan expired due to non-use

All refund requests must be submitted to support@simplyesim.app, and Simply reserves the right to deny a refund at its discretion.

 

8. Acceptable Use

You agree:

  • Not to misuse or attempt to reverse-engineer our systems
  • Not to violate applicable laws or use the Services for prohibited activities
  • Not to resell or transfer eSIMs without prior written consent
  • Not to abuse referral or promotional programs

We may suspend or terminate accounts that violate this policy.

 

9. Intellectual Property

All content on the Simply platform—including but not limited to text, graphics, logos, software, and designs—is the property of Simply or its licensors. You may not copy, distribute, or modify content without express permission.

 

10. Disclaimer of Warranties

We provide Services on an "as-is" and "as-available" basis. We do not guarantee that the Services will be uninterrupted, error-free, or compatible with all devices.

We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

 

11. Limitation of Liability

To the maximum extent permitted by law, Simply shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of data, profits, or service availability
  • Issues arising from third-party providers (e.g., mobile networks)
     

Our total liability shall not exceed the amount you paid for the affected plan.

 

12. Termination

We may suspend or terminate your access to the Services at any time:

  • For violation of these Terms
  • To comply with legal obligations
  • In case of fraud or misuse

You may also delete your Account at any time via the app or by emailing us.

 

13. Modifications

We may update these Terms periodically. Changes will be communicated via the app, website, or email. Continued use of the Services after changes means acceptance of the updated Terms.

 

14. Governing Law

These Terms shall be governed by applicable laws in the jurisdiction where Simply is established. In case of disputes, the courts of that jurisdiction shall have exclusive authority, unless otherwise provided by local consumer laws.
